Terms and Conditions of Use

1. Acceptance of Terms

By accessing or using Firestarter ("Service", "Platform"), the user ("User") agrees to be bound by these Terms and Conditions ("Terms"), our Privacy Policy and all applicable laws. If you do not agree with these Terms in full, you must immediately stop using the Service. Firestarter reserves the right to update these Terms at any time, with changes communicated by email or via notice on the Platform.

2. Financial Disclaimer — IMPORTANT NOTICE

FIRESTARTER DOES NOT PROVIDE FINANCIAL, TAX, LEGAL OR INVESTMENT ADVICE. All information available on the Platform — including calculations, projections, simulations, scenarios, scores, benchmarks, AI-generated suggestions and any other content — is for INFORMATIONAL and EDUCATIONAL purposes only and does not constitute investment advice, qualified financial opinion, tax counsel or any form of regulated advisory.

The User expressly acknowledges that: (a) results presented are estimates based on simplified assumptions and may not reflect future reality; (b) past performance of financial markets does not guarantee future results; (c) any investment, saving, disinvestment or personal financial decision is the sole responsibility of the User; (d) Firestarter is not regulated by the FCA, SEC, CMVM, CVM or any other financial supervisory authority; (e) the User should consult a duly qualified financial adviser, tax professional or lawyer before making any decision based on information provided by the Platform.

Firestarter is not liable for any financial losses, direct or indirect, resulting from the use of or reliance on the information provided.

3. Description of Service

Firestarter is a web application that allows Users to calculate their FIRE number (Financial Independence, Retire Early), track their financial independence progress, simulate hypothetical scenarios, compare metrics with anonymous benchmarks and receive AI-generated analyses. The Service is available on a freemium basis, with premium features accessible via paid subscription. Firestarter reserves the right to change, suspend or discontinue any feature at any time.

4. User Account and Security

The User is responsible for maintaining the confidentiality of their access credentials and for all activities carried out under their account. The following are strictly prohibited: (a) sharing access credentials; (b) creating false or multiple accounts; (c) using automated means to access the Service without express authorisation.

5. Subscriptions, Payments and Refunds

Payment processing is carried out by Stripe, Inc. Firestarter does not store card data. Subscriptions renew automatically unless cancelled by the User before the end of the current period via the Stripe Customer Portal. Users resident in the European Union or the United Kingdom may exercise the right of withdrawal within 14 days of subscription, provided they have not used the premium Service during that period. UK Users are entitled to rights under the Consumer Rights Act 2015.

6. Artificial Intelligence and Automatically Generated Content

Firestarter uses AI models provided by Anthropic, PBC ("Claude") to generate personalised analyses and suggestions. The User acknowledges that: (a) AI-generated content may contain errors or inaccuracies; (b) it must not be interpreted as professional advice of any kind; (c) the User must not make financial decisions based solely on AI-generated content without validation by a qualified professional.

7. Intellectual Property

All content on the Platform — including but not limited to code, design, algorithms, logos, text, graphics and interface — is the exclusive property of Firestarter or its licensors and is protected by copyright, trademarks and other applicable intellectual property rights. It is strictly prohibited to reproduce, distribute, modify, create derivative works, reverse-engineer or commercially exploit any part of the Service without prior written authorisation.

8. Prohibited Uses

The User agrees not to use the Service for: (a) any illegal or unauthorised purpose; (b) transmitting viruses, malware or malicious code; (c) attempting unauthorised access to systems or data; (d) code injection, SQL injection, cross-site scripting or any other cyber attack; (e) collecting other users' data without consent; (f) interfering with the normal operation of the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIRESTARTER, ITS DIRECTORS, EMPLOYEES, PARTNERS AND SUPPLIERS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES OR GOODWILL. Firestarter's total liability to the User shall not exceed the amount paid in the 12 months prior to the event giving rise to liability or €50, whichever is lower.

10. Governing Law and Dispute Resolution

These Terms are governed by Portuguese law. For Users resident in the European Union, the mandatory consumer protection rules of the User's country of residence also apply. For UK Users, the Consumer Rights Act 2015 and UK GDPR apply additionally. Disputes shall first be submitted to mediation. In the absence of an amicable resolution, the courts of the district of Lisbon, Portugal shall have jurisdiction. Contact: legal@firestarter.app
